Can I be forced to live in my self build property for 3 years or due to financial hardship can I sell now without living in it?

    Hi Rosemary,

    Firstly, we’re sorry to hear that financial issues mean you may be forced to move out of your self build.

    I’m not sure what convenants you’re referring to, so it’s difficult to give any firm advice.

    There is a self build exemption to the Community Infrastructure Levy, where you must agree to stay in the house for 3 years in order to avoid paying the CIL charge.

    In this case, that doesn’t mean you can’t sell your home within 3 years – but it would mean that you become liable for the CIL charge (which can run into £10,000s, depending on what your local council charges).

    It might be a good idea to get some initial advice from a local planning consultant or specialist lawyer who can help you better understand your options.
