I have a piece of land next to me that once belonged to the builder and is not owned by the council & have checked with land registry. What steps do I need to take to claim/use this?

    Requisitioning land as your own is a difficult and lengthy process.

    Assuming that the title is not registered, you will need to first possess the site. To do this you will have to start by fencing it and then maintaining it on a regular basis.

    You will have to continue to occupy this area for a period of at least 12 years, over which you would need to document each and every step you took to possess it, as well as your continuing upkeep of the plot. You will need this paperwork as evidence for when you come to make a claim for formal possession. However, if an owner does come out of the woodwork during this process, you will be trespassing and could be regarded as having caused damage.

    You should also be aware that legislation states that possession of the land must be without consent – meaning if an owner has allowed you to make use of their plot, this will effectively negate the possibility of you claiming ownership in the foreseeable future.
