What are the Council’s Obligations Under the Right to Build Scheme?

Hello,
Great to read your latest update on the Right to Build register (which is in place in Stafford). However, I cannot seem to see any duty for a council to publicise where self build sites are, nor to publicise whether they are meeting requirements.
It seems that they can simply refuse to do so, but have fulfilled their duty by maintaining the list. Is this correct or am I missing something?

  1. I think your interpretation is right. Frustratingly, Local Planning Authorities do not have to publish their registers, nor publish a list of suitable plots.

Their responsibility is to have due consideration of the numbers on the registers when formulating their local plans and to ensure that there are sufficient serviced plots available to meet the numbers indicated on the register.

The first 3-year tranche ends on 31 October 2019 and at that point we will see how many local authorities have actually met the remit of the act by permissioning enough suitable plots to meet demand.
