Build your dream home with confidence
BOOK YOUR TWO FREE TICKETS HEREI have bought a fantastic plot and planning looks like it is going to go through end of Dec ’15. I am shocked to find out that the LA are quoting £54,800 for the 106 fee for our 3 bed build. This is nearly one quarter of my budget. If built, the house will be worth plenty but that is not the point, I didn’t choose to be brought up in an area with expensive property (which is why I could never buy my own home)!
Who can I speak to? Should I withdraw the planning app until the gov make a decisive move? Is timing crucial?

Earlier this year the government effectively banned Section 106 contributions on schemes of 10 houses or less. That decision was then ruled unlawful, following a high court challenge from a group of councils. The government has been given leave to appeal that decision, so we now wait to see which way things will go. So, yes, timing is crucial, but whether and when the high court decision will be reversed is unknown. If you can wait, I’d withdraw your application and see what happens. Bear in mind that if you got permission subject to the Section 106, you’d have to reapply in due course in any case (assuming you hadn’t paid the money or started the project). Meanwhile, the sum sought appears excessive and it would be worth querying it.
