Hi,

If I buy land off of a farmer, is that land still considered agricultural even if it isn't part of an active farm?

Thanks

  1. Mike Dade says:

If land has been part of an agricultural unit, then its use would continue to be considered agricultural, even after it was severed from the farm. The other possibility is that such land could acquire a so-called nil use, if empty and used for nothing at all for a long period. The distinction is academic as far as getting planning permission to build a house is concerned.
