Who takes responsibility for a damaged floor?

After our underfloor heating system was installed, we had a screed floor fitted to the ground floor of our house. Once the screed had dried out properly, we hired a professional to lay travertine tiles. Less than a month later the tiles have become loose, and it’s been drawn to my attention that a primer should have been used prior to the tiles being laid. The underfloor heating company have reassured us that the system is designed correctly and we are positive that the floor had the right amount of drying out time before the tiles were put down. Who should take responsibility for this and how do we resolve it?

It seems clear that the screed is not damaged or defective, therefore the problem lies with the tiler, who didn’t adequately assess the screed on which he was to lay his tiles. But you need to make sure the tiler made no assumptions in his original quotation/contract that were subsequently proved to be different on site. If you have site insurance cover, and the policy is still in place, then you should check with your provider to see if they have some legal expenses cover in place. Basically, this is a contract dispute, and will therefore probably require legal help to resolve.
