Larger Home Extensions

I am planning to start on my new build in March 2020 and would like to do the foundation for the extension at the beginning with the foundation of the house:
1) Can I legally do this?
The plan was approved with 3 meters extension (with further permitted development right taken off) but would like to take
advantage of the 8 meters extension for a detached house to add the extra 5 meters extension foundation at the beginning.
2) When can I notify the council about my plan being a new build?

    If you want to depart from the permitted plans, ideally, get your permission amended first. In the scenario you describe, if you build foundations for a future extension, the council could take the view you have departed from the permitted scheme. That said, foundations alone shouldn’t trigger their interest but it’s not without risk. The legalities, as so often with planning, are open to interpretation. However, if, as you say, further permitted development rights have been taken off, then a larger 8 metre rear extension would require a full planning application. Unless you’re confident this would be granted, you’d be taking quite a risk with spending money on foundations.
