When should you pay for extra work?

Our groundworks contractor is working on our foundations and has hit what he calls a ‘soft spot’. He wants extra money for digging it out and filling it in, although we don’t understand what a ‘soft spot’ is. However, we think it’s his responsibility and he should pay for it. Who is right in this matter and how should we resolve it?

Answers

Soft spots are pockets of underground material, such as peat or mud, that must be removed to allow foundations to be safely laid. The cost of paying for this usually lies with the client or employer, because the contractor had no way of knowing this beforehand, unless you paid him to carry out a site survey before the quoted was made. Perhaps you could reach a compromise; tell the contractor it is not within your budget and ask him to carry out the work for cost.
