Can we move into our new self build home?

My partner has completed our brand new self built 3 bedroomed semi-detached home. Buildings regs have been signed-off and all the relevant certificates sent to our local authority. However, they now require a plan for the garden, which has been submitted, along with the fee.

He is of the opinion that, although he is paying council tax, he cannot move in until the planning department have passed the garden and the kerbside drop for our cars. He has been staying in the property on the odd occasion but is paranoid that I cannot move in until the planners have stamped everything…including my forehead!!

Please can someone confirm if he is correct……many thanks.

If the garden plan and kerb drop were planning conditions, and it stipulated that they had to be completed before occupation, then you should get the work done first as they are essential for approval.

However, if this isn’t the case, then there is no reason why you should not move in once you have obtained a certificate of habitation, which states that although the house is not technically complete, you can live in it. It’s quite a common procedure and you can speak to your planners to get this arranged.
