Joint use septic tanks

Having built a replacement cottage our neighbour is now refusing us access to the joint use septic tank on his land. He says our new cottage is much bigger than the one it replaced (it’s exactly 50% larger) and therefore the right of easement in our Deeds no longer applies. He’s blocked our drain at his boundary and is demanding we install a waste treatment plant in our garden. The garden’s tiny so he has agreed to allow us to run the outfall pipe across his land to a ditch/watercourse as long as we take the pipe in a route across 90 metres of paddock land. He’s telling people he’ll tie us up for months even if we agree to everything. He seems adamant that he would win at court because we replaced the original building with something larger. The new cottage is a three bed but still only 1,000sq ft. Planners say it’s not their responsibility as does Building Control and Environment Agency unless there’s a pollution issue. Anyone been in a similar position?
