Do I need to pay Section 106 Contributions?

I’m trying to obtain planning for a conversion of a chapel to a residential two bed single storey bungalow. The floor size in total is 70m2. I understand that I may be exempt from such contributions if my dwelling is less than 95m2. The small gospel chapel is going to be my retirement home. The plannng officers say every dwelling is subject to this contribution. This is in Carmathen county council. Please advise.

At the time of your post, you would have been liable to pay S106 contributions if that was the policy of the local authority. Since then, the original exemption for 10 houses and below has been reinstated following a Judgement in the Appeal Court earlier this month. That decision could still be challenged in the Supreme Court, but you should have the exemption if you apply now. As the Chapel was not residential and you are converting it into a home, you should qualify for the exemption. However, you are in Wales and the Welsh assembly might have different ideas. As the decision is so new, I don’t know what the Welsh take on the judgement is. Challenge it, anyway.
