Can I Build an Annexe on My Land?

I own a raised ground floor apartment above a terraced building with only two apartments and a shop on the ground floor. All the land to the rear is part of my property and has access to a private road.

Can an annexe be built on the land I own where my garage is at present? Planning is treating my application as a single dwelling and insisting that a 50m2 of private rear amenity is required for the proposed dwelling.

    While an annexe might be permitted in the grounds of a house, the situation is more complex with an apartment. In planning terms an annexe is only an annexe if it represents ancillary accommodation.

    To be considered ancillary, the accommodation would have to be subservient – that is – significantly smaller, than the apartment, and immediately accessible to it. The fact that the council is insisting on calling the annexe a new dwelling suggests it does not view it as being ancillary.

    Unfortunately, apartments don’t enjoy the same permitted development rights as houses, so you can’t just build a suitable outbuilding as permitted development.
